Conditions

1. Scope

All sales and deliveries executed by Hatira Shop are subject to those conditions as long as they have not been altered or amended by written agreement.

2. Scope of Supply

The delivery of the object of purchase is effected according to the documents of sale. We reserve the right to minimal design modifications and color deviation. Minor deviations do not entitle to formal complaint.

3. Prices

The price list valid at the time of the conclusion of the contract applies. All prices, unless agreed otherwise, include the value-added tax and the pre-paid legal disposal fee.

4. Terms of Payment

Payment will be accepted in any of the following methods: Post Finance payment by card, payment via invoice (payable within 20 days), credit card VISA/MasterCard and PayPal (in CHF, USD and EURO).

Late payment costs

The payment term for orders on invoice is 20 days. Late payment will incur default charges as listed below.

Reminder charges

1st reminder: EUR 10.00

2nd reminder: EUR 20.00

After the end of the payment period and a one-off reminder you have to pay an extra charge of CHF 10.00. After the 2nd reminder we will charge you 20.00 Fr. In the case of a submission to a debt recovery service we will charge you fees according the table below. During the period of default, Edelweiss Shop is entitled to withdraw from the contract, to reclaim delivered goods and to claim damages resulting from the failure of the contract.

5. Offers, Agreement of Contract & Reservation of Title

The display of the product offer in our online-shop is not a legally binding offer but rather a non-binding online catalog- By clicking the button “Send order” you agree to a binding order of all products in the shopping cart. The confirmation of the entrance of the order occurs together with the acceptance of the order immediately by the sending of automated e-mail. The purchase contract takes effect with this email confirmation.

The order contract will be stored on our internal systems and we will send you the order data. We will not send you the General Terms and Conditions, but you can access them anytime on this page. As far as you provided a customer account you can access your customer data at any time under “My account”. It is possible to conclude the contract in German and in English. The deliveries and services shall be performed exclusively under retention of title. The goods supplied by us shall remain our property until the buyer has discharged all our claims from him, especially until the purchase price is paid in full. In the event of behavior contrary to our contract on the part of the client, such as default of payment, the seller shall be authorized to withdraw from the contract and to demand immediate return of the reserved property to put them up for sale again.

6. Delivery Conditions

Delivery times can reach up to 20 days depending on the country of destination. Delivery within Switzerland is carried out within 2-3 days. All data are without guarantee. Failure by the supplier to meet the delivery dates does not entitle the customer to terminate the contract nor to make further demands. Any delayed in delivery of goods does not entitle the customer to reject acceptance. In case of questions please contact us directly via email or phone.

7. Shipment and Risk taking

The contractual products will be controlled and commercially packed.

If the delivery times are delayed by circumstances not caused by our company, in particular by late delivery of the post, force majeure, obstruction of operation and traffic or other similar circumstances, the delivery time shall be extended by the term of the delay.

8. Taxes and Tariffs

Taxes may apply for shipment to countries outside of Switzerland that the customer has to carry. These vary in different customs areas. The customer is responsible for the correct processing of any necessary duties and fees. Import duties are not shipping costs.

The shipping costs are summarized in the form of flat charges. More information available here. For deliveries to clients outside of Switzerland Swiss value-added tax of 7.7% (2.5% for books) does not apply. This is automatically considered after closing your purchase. Please note that for deliveries outside of Switzerland additional toll costs or other fees depending on the country may occur. Those are not included in the final price of orders.

9. Warranty and Liability

The warranty period for products sold by our company is 1 years after date of delivery (in accordance with invoice) if not explicitly agreed on otherwise. The Warranty includes defects in material and workmanship during normal usage and storage. It covers the free replacement of spare parts, the substitution by an equal product or if necessary the reimbursement of the amount paid excluding the shipping charges in the form of a credit, as far as we have recognized their necessity.

Excluded from the warranty are:

-Damages resulting from carelessness, improper handling/usage or other device manipulations,

-damages resulting from device manipulations or the addition and insertion of non-original parts,

-damages as a consequence of leaking of battery or otherwise insufficient care of the equipment,

-damages on normal wear, consumable and wear parts as well as on batteries and accumulators.

Warranty claims may only be submitted by the buyer and are non-transferable. Apart from the listed warranty claims above, the buyer has no rights relating to a defect.

The usage of the offered goods on our website is at one’s own risk. It is pointed out to the customer that the products may only be used for the intended purpose and that they are not suitable for children. We assume no responsibility or liability for any form of direct or indirect consequential damages insofar as the customer does not provide proof for intent or gross negligence. Every form of product liability or product liability claim that may be inferred from other regulations is excluded to the extent permitted by law- regardless of legal reasons. The liability for slight negligence is excluded as well.

All of our knifes are being sent to persons of full age exclusively. The customer claims to be off full age by purchasing a product, placing the order and/or by entering the date of birth.

10. External Links

We do not have any influence or take any responsibility for the content and design of external links. Our liability shall be excluded from wrong information or unlawful acts. Responsible for the content of external links are the respective providers.

When first setting up the external links we checked for any legal violations. This, however, excludes the assessment of future updates.

We ask the customer to redirect questionable links to Hatira Shop to be able to assess and, if required, delete them.

11. Revocation & Consequences of Revocation

The customer is entitled to cancel the order without reasons within 14 days after the receipt of the ordered goods in either written form (e.g. letter, email) or by returning the goods to Hatira Shop. The period begins at the earliest with the receipt of the goods. For period keeping the punctual sending of the revocation or of the goods is sufficient. The revocation in written form is to be sens to our address

The customer carries the burden of proof for the dispatch of the goods to be returned.

In the case of an effective revocation the customer is obliged to return the received goods. If the customer is not able to return the received products in whole or only partly or in deteriorated condition the customer must reimburse Hatira Shop for the reduced value thereof. In case that the customer has already paid the purchase price, Hatira Shop is entitled to deduct the redced value from the repayment amount. In individual cases the reduction in value may correspond to the purchase price.

The customer has to bare the shipping costs, the costs for returning the goods, customs duties and value-added tax, unless the delivered goods or services do not correspond to those ordered.

12. Applicable Law/ Jurisdiction

Swiss law terms apply even if goods are ordered from or delivered abroad. Jurisdiction for all claims connected to your order is Dietikon, Switzerland. The ineffectiveness of individual regulations does not affect the remaining conditions of the contract or of this GTC.

13. Severability Clause

Should individual or several conditions of this contract be ineffective or unviable or becomes invalid or unviable after the conclusion of the contract, the agreement shall remain unaffected in all other respects. The invalid or unfeasible provision shall be replaced by a provision corresponding to the intended purpose, to the spirits and objectives of this contract agreement. The aforementioned provisions apply accordingly in the event that the contract is found to be incomplete.</
